Immigration Waivers Attorney Serving Clients Nationwide

Overcoming immigration barriers—one waiver at a time.

Certain immigration violations can block you from getting a visa, green card, or lawful status. A waiver may be the legal solution that allows you to move forward.

At Haim Vasquez Legal Group, we help individuals and families overcome grounds of inadmissibility and deportability through carefully prepared immigration waivers. Whether your case involves unlawful presence, prior deportation, misrepresentation, criminal history, or other immigration violations, we act strategically and with urgency. Waiver cases are highly fact-specific, evidence-heavy, and unforgiving of mistakes. One weak argument or missing document can result in a permanent denial.

You do not have to navigate this process alone. With the right legal strategy, many immigration barriers can be overcome.

Common Immigration Waivers We Handle

Form I-601 – Waiver of Grounds of Inadmissibility

Used in cases involving:

  • Unlawful presence
  • Certain criminal convictions
  • Fraud or misrepresentation
  • Health-related grounds

Requires showing that a U.S. citizen or lawful permanent resident spouse or parent would suffer extreme hardship if the visa or permanent residence is denied.

Allows individuals to request a waiver of the 3- or 10-year unlawful presence bar before leaving the United States for consular processing. This waiver is filed before departing the country and helps reduce family separation time.
Extreme hardship must be shown to a:

  • U.S. citizen spouse, or
  • U.S. citizen or lawful permanent resident parent

For individuals with:

  • A prior deportation
  • A final order of removal

This waiver allows a person to request lawful admission to the United States again. It is often filed together with an I-601 waiver or during consular processing.

For nonimmigrants who are inadmissible, including cases involving:

  • U visa applicants
  • Criminal history
  • Prior immigration violations

Requests permission to enter the United States temporarily despite inadmissibility.

For refugees or asylees who are inadmissible due to:

  • Criminal history
  • Health-related grounds or other inadmissibility issues

Allows adjustment of status despite inadmissibility.

Waives certain criminal grounds of inadmissibility, including:

  • Crimes involving moral turpitude
  • Prostitution-related offenses

Often filed together with adjustment of status applications within the United States.

Used to prevent removal based on fraud or misrepresentation during immigration processes, particularly when there are strong family ties or humanitarian factors supporting relief.

Eligibility depends on the violation, your immigration history, and whether you have a qualifying U.S. citizen or lawful permanent resident family member. Many waivers require proof of extreme hardship. Each case must be evaluated individually.

Processing times vary by waiver type and case complexity. Some take several months, while others may take a year or more. Delays often occur when evidence is incomplete or additional information is requested.
