U Visa – For Victims of Qualifying Crimes
The U Visa is available to victims of certain crimes who have suffered substantial physical or mental abuse and are helpful to law enforcement or prosecutors in the investigation or prosecution of that crime.
Common qualifying crimes include: Domestic violence, Sexual assault, Felonious assault, Kidnapping, Human trafficking, Stalking, Extortion, False imprisonment, Witness tampering, and other crimes recognized by USCIS
- Protection from deportation
- Authorization to live and work in the U.S. for up to four years
- Eligibility to apply for a green card after three years (Form I-485)
- Derivative visas for qualifying family members, including spouses, children, parents, and, in some cases, siblings
- Preparing Form I-918 and all supporting evidence
- Law enforcement certification requests (Form I-918 Supplement B)
- Filing waivers of inadmissibility (Form I-192)
- Communicating with police departments, prosecutors, and agencies
- Preparing derivative U Visa applications for family members
T Visa – For Victims of Human Trafficking
- You are a victim of a severe form of trafficking
- You are physically present in the U.S. because of the trafficking
- You cooperated with reasonable law enforcement requests (or are under 18 or unable due to trauma)
- You would suffer extreme hardship if removed from the United States
- Four years of lawful status and work authorization
- A pathway to permanent residency after three years or completion of the investigation
- Derivative status for qualifying family members, including spouses, children, parents, and unmarried siblings under 18
- Filing Form I-914 and supporting documentation
- Preparing waivers of inadmissibility (Form I-192)
- Coordinating with social service providers and victim advocates
- Filing derivative family member applications (Form I-914A)
